Terms of Service
Turn On AI Last updated: [DATE]
These terms are a deal between you and [ENTITY NAME, a Texas limited liability company], doing business as Turn On AI ("we," "us"). They cover our website and everything you buy from us. By using the site or buying from us, you agree to them.
If you sign a separate client agreement with us, that agreement wins where the two are different.
1. Who we work with
We work with businesses. You must be 18 or older and allowed to act for your business. When you buy, you're buying for your business, not for personal use.
2. What we do
We set up AI features inside the software you already use, like Jobber, Housecall Pro or ServiceTitan. Then we test them, and if you want, we keep them running.
We're independent. We aren't affiliated with or endorsed by Jobber, Housecall Pro, ServiceTitan or any other software company. We don't resell software. We don't take commissions or referral fees from software companies.
3. Your accounts are yours
- You own your software accounts, your settings and your data. If you leave us, everything stays in your account.
- We never need your password. Don't send it to us. Not by email, chat, text or form.
- For Setup and the monthly plan, you add us as a user on your account. You choose what we can see and do. You can remove us anytime.
- You pay your software company directly for its plans and add-ons. Those fees are between you and them. [ATTY/OPS: some vendors charge per user seat. Say who pays for our seat.]
3a. Cell Phone Starter: your phone and accounts
Your phone number, carrier account, Google account and app account stay in your name and on your card. You make the changes on your own phone and computer while we walk you through them. We never ask for your passwords or the codes your accounts text you, and we don't keep any login. Your carrier may count forwarded calls as minutes used. Charges from your carrier or the app company are between you and them. The app company's terms and privacy policy cover the calls its app answers and records. You can turn forwarding off anytime with the code on your cheat sheet. We keep private anything we see while helping you, like customer names or calendar entries. We aren't responsible for outages or changes made by your carrier, phone maker, Google or the app company. If one of them breaks the setup, Keep It Working covers resetting it. [ATTORNEY: last two sentences sit inside the liability cap in section 15.]
4. The free phone test
- You give us your shop's number. After you close, one of us calls once, like a new customer would. Then we text or email you what happened.
- We don't record the call. We don't book a real job. It's free.
- You must own or manage the business and be allowed to approve the test. Your staff or answering service may not be told ahead of time.
- We share the results only with you.
- Results texts are facts only. Reply STOP to stop texts. Msg & data rates may apply.
- We may skip a test if we can't confirm the number belongs to your business.
5. What you can buy
$199 AI checkup. You send us screenshots and notes about your software and phone setup. We send you a one page report: what AI you have, what's off, and what it costs to turn on. We never ask for passwords. Please blur anything you don't want us to see. The $199 comes off Setup if you set up with us within [ATTY/CHRIS: time limit, for example 60 days].
Setup: $1,500 ($3,000 with the owner dashboard). One time. We set up the AI to answer your phone and book jobs your way. Then we test it. Before you pay, you get a written test plan. Anything not in the test plan or your order isn't included. Extra work needs your OK first, in writing, with a price.
Monthly: $397 a month. Test calls every month. We fix it when something breaks. You get a one page report every month.
- 90 day minimum. The first 90 days are a commitment. After that, it's month to month.
- It renews every month on the same date and charges your card until you cancel.
- Paying yearly: two months free. [ATTY/CHRIS: decide and state what happens if a yearly client cancels early, and whether the year renews. See attorney list.]
Prices are in U.S. dollars. Prices don't include sales tax. We add tax if Texas law requires it. [CPA: confirm.]
6. Our two promises
$199 checkup: If your checkup doesn't tell you something useful you didn't already know, email us within 14 days of the day we send it. You decide. We refund the full $199 within 2 business days. Once the $199 is credited toward Setup, this refund ends.
Setup: Before you pay, you get a written test plan: the calls we'll make and what has to happen on each one. It doesn't go live until it passes every test. If we can't get it to pass within 30 days, you get back everything you paid us for Setup.
Setup promise details.
- Test plan. It lists each test call and what must happen on it. For example: it answers, gets the caller's name, number and job right, books or routes the call the way you chose, and sends you the alert. "Passes" means every item on the test plan passes in one test run.
- Go live. We don't turn the AI on for your customers until it passes.
- The 30 days. The 30 days start once you've given us account access and turned on any add-on your plan needs. The clock pauses only while we're waiting on you. If it hasn't passed by then, you choose: a full refund of what you paid us for Setup, or let us keep working.
- What's not included. Fees you pay Jobber, Housecall Pro or ServiceTitan are between you and them. They aren't part of this refund.
- What passing means. Passing means it handled our test calls the way the plan says. AI can still make mistakes on real calls. The refund above is your remedy if Setup doesn't pass. [ATTY: confirm this sentence.]
How to ask for a refund: see our Refund Policy.
7. What we don't promise
- We don't promise more jobs, more calls or more money.
- We don't promise the AI will never miss a call or never make a mistake. AI can get things wrong.
- We promise it's set up, it passes the test plan, and (on the monthly plan) we keep checking it.
- Software companies change their features, prices and rules. They have outages. We don't control that.
- Any cost or savings number we give you is an estimate. We tell you what it's based on.
8. Your part
- Give us true information and the access we need.
- Look over what the AI says to your customers before it goes live. You approve it.
- Your business is responsible for the rules on your own customer calls and texts. That includes call recording notices, texting consent and privacy notices.
- Don't use our work for anything illegal, or to spam or trick people.
9. Canceling the monthly plan
- How: email [SUPPORT EMAIL] or use the billing link in your receipt. [OPS: Stripe customer portal link.] You can cancel the same way you signed up: online.
- When it ends: at the end of the month you've already paid for. We don't charge you again after that.
- During the 90 day minimum: you can give notice anytime. [ATTY/CHRIS: pick one. Option A: you still owe the rest of the 90 days. Option B: you can leave early, no more charges.]
- After you cancel, we remove our user from your account (or you can). Everything we built stays in your account.
- We'll email you before any yearly renewal.
We can end the monthly plan with [30] days' email notice. If we do, we refund any prepaid months we haven't used.
10. Payments
We take payment by card through Stripe. We don't see or store your full card number. If a charge fails, we'll email you. We may pause work until it's paid.
Please contact us before disputing a charge with your bank. Most problems we can fix in a day.
11. Our chat assistant
The chat on our site is an AI assistant. It runs on Claude, made by Anthropic. It can make mistakes. Our real prices and promises are the ones on our pricing page and in your order. If the chat says something different, ask us and a person will sort it out. Don't put passwords, card numbers or private customer details in the chat.
[ATTY: courts have held businesses to what their chatbot said (Moffatt v. Air Canada, 2024 BCCRT 149, Canadian). This line helps but won't fully protect us. The real fix is a chat that only answers from approved facts, which it does today.]
12. Our stuff and your stuff
- You own your data and your accounts. You own the settings we create in your account once you've paid.
- We keep our own know-how: our templates, checklists, prompts, test scripts and methods. You may use what we set up for your own business.
- The site and its content belong to us. Don't copy it for a competing business.
- We won't use your name, logo or results in our marketing unless you say yes in writing.
13. Privacy and confidentiality
We keep your business information private. We use it only to do the work for you. Our Privacy Policy explains what we collect and who helps us run the site.
14. Warranty disclaimer
[ATTY: write this section. Texas requires it to be conspicuous (bold or caps) to count. It must not undercut the two promises in Section 6, and the DTPA can't be waived here (Tex. Bus. & Com. Code § 17.42). Plain English target: "Except for what we promise in these terms, we provide the site and our services as is."]
15. Limits on what we owe
[ATTY: write this section. Suggested points from the 10/20 memo:
- Our total liability is capped at what you paid us for the service at issue (Setup), or the last 12 months' fees (monthly plan). [ATTY: pick the cap.]
- No liability for lost profits, lost jobs or indirect damages.
- Must be conspicuous under Texas fair notice rules.
- Must not cut back the two refund promises.]
16. Disputes
- Texas law applies.
- Talk to us first. Email [SUPPORT EMAIL] and give us 30 days to fix it.
- Any lawsuit goes in the state or federal courts in Dallas County, Texas. Either side can use small claims court if the claim fits.
- [ATTY: decide whether to add arbitration. Default draft: no arbitration.]
17. Changes
We may update these terms. We'll post the new date at the top. For monthly clients, we'll email you at least [30] days before a change that affects you. If you don't like it, you can cancel before it starts. Changes never cut back a refund you already earned.
18. Other legal basics
If a court strikes one part, the rest still stands. If we don't enforce a term once, we can still enforce it later. Neither side is responsible for delays caused by things truly outside its control, like a vendor outage, but this never cancels the Setup refund promise.
